The Building Engineering Services Association (BESA) is the UK's leading trade organisation for building engineering services contractors – representing the interests of firms active in the design, installation, commissioning, maintenance, control and management of engineering systems and services in buildings. BESA is a not-for-profit Association currently representing over 1,200 member companies.

 

BESA has a proud heritage, having been established in 1904 as the National Association of Master Heating and Domestic Engineers. BESA’s headquarters are in London, but we are active throughout the UK. We have a separate presence in Scotland, Wales and Northern Ireland, as well as eight regional offices across England.  The Building Engineering Services Association group of companies offer a vast range of services, all developed with the needs of businesses operating in the building engineering services sector.

 

THE Legal & Commercial department

The Legal & Commercial Department is one of BESA’s key service departments and is a highly valued and visible benefit of membership - it is held in high regard and is noted for its professionalism.

The team provide advice to members and represents members’ interests to a broad range of stakeholders as well as delivering internal advice across the BESA corporate group together with managing & administering the BESA governance regime. 

Its role is to:

  • advise members on a wide range of legal, commercial, corporate and contractual matters
  • prepare and deliver in innovative ways, general guidance to members on a wide range of legal, commercial and contractual issues
  • represent members’ interests to improve the commercial environment in which they operate
  • actively seek member support services of a commercial and legal nature
  • advise on and enable management of legal matters to assist other internal service departments or group subsidiaries and to act as guardians to BESA Group legal risk profile.

 

KEY DUTIES

One of a team of 5, the role will be to:

undertake, research and provide practical commercial and legal advice to Association members so that they can make informed commercial judgements about the risks involved in their contracting activities

represent the needs and interests of BESA members

provide other departments and parts of the Group with advice, guidance and assistance

attend and make presentations at national and regional meetings including lecturing or making presentations on commercial, legal or contractual issues;

prepare agendas, minutes and supporting documents for BESA committee

undertake project work of a legal or commercial nature

manage multiple tasks and projects with competing priorities

respond to external consultations on matters that affect members.

 


QUALIFICATION, KNOWLEDGE & EXPERIENCE

ESSENTIAL

 

Solicitor with a minimum of 1 year post-qualification experience

Proficient in legal research skills

Professional written and oral communications skills

Experience of advising on standard and non-standard construction contracts

Sound knowledge of the UK construction industry

Familiarity with the legislative framework that affects construction contracts

Understanding of commercial contracts

Proficient IT skills – familiarity with the use of Microsoft Office is essential

Ability to travel within the British Isles

DESIRABLE

Mixed contentious and non-contentious experience

Awareness of UK intellectual property system

Awareness and practical ability to manage corporate group issues
