BIM Legal Perspective (contract management)

BIM – Building Information Modelling (or Management) – has grown from 3D CAD into a technology and process driven way of constructing and managing property portfolios in five dimensions through their life cycle, from inception to dilapidation. While the motivation for BIM may have initially come from specific UK Government requirements to move Government projects to become BIM collaborative, many companies across the UK (and worldwide) are now seeing the benefits of this innovative technology.

BIM – Building Information Modelling (or Management) – has grown from 3D CAD into a technology and process driven way of constructing and managing property portfolios in five dimensions through their life cycle, from inception to dilapidation. While the motivation for BIM may have initially come from specific UK Government requirements to move Government projects to become BIM collaborative, many companies across the UK (and worldwide) are now seeing the benefits of this innovative technology.
In reality, there is a real drive for clients to improve the efficiency and productivity in the way they procure, design, construct and manage their assets.


Over the last decade the building and engineering services sector has seen a shift in contracts away from JCT to NEC - although JCT still accounts for approximately 62% of the market, with NEC taking 14% and the remainder being bespoke contracts loosely based on JCT drafting.

At present however, there is nothing in the market that amends any of these contracts to truly address the legal and risk-based issues that arise within the context of BIM. According to a 2018 industry survey, only 21% of industry participants claimed to have amended their contracts to fully integrate BIM. 2 Remember that there is nothing wrong with a good clear contract that acts as a pre-nuptial agreement and explicitly sets out client requirements between parties who are forming a relationship for the sake of completing quality projects.
