Until now within the UK, information personal to individuals (known as personal data) has been subject to the Data Protection Act 1998 (DPA) and the EU Data Protection Directive 95/46. This required businesses to take steps to mitigate the risk of non-compliance. The rules under this framework comprised of eight principles and those subject to the rules are left with the task of interpreting how the principles applied to their systems processes and management of data which fell within the remit of the legislative framework.
